HUKUM SHALAT JUM'AT YANG BERTEPATAN DENGAN HARI RAYA: ANALISIS KOMPARATIF MAZHAB DAN ISTINBATH DEWAN HISBAH PERSATUAN ISLAM (PERSIS)

The coincidence of Eid ('Îd) and Friday (Jum'ah) on the same day is a rare occurrence that raises significant legal questions among Muslims. This phenomenon occurred in Indonesia in 2025, causing confusion among the public due to divergent fatwas circulating in society. This study aims to analyze the shar'î arguments employed by scholars of the four major legal schools (madhabs), map the positions of contemporary scholars, and examine the legal methodology (istinbâth) of the Dewan Hisbah of Persatuan Islam (PERSIS) in determining the relevant ruling. A qualitative library research method is employed, utilizing a comparative fiqh (fiqh muqâran) approach and tarjîh analysis. The findings indicate that madhab scholars are divided into two main camps: the Hanafi and Shafi'i schools hold Friday Prayer to remain obligatory in absolute terms, while the Hanbali school grants a dispensation (rukhshah) to worshippers who have already performed the Eid prayer. The Dewan Hisbah of PERSIS, operating through its distinctive methodology of ittibâ' al-dalîl and rejection of blind imitation (taqlîd), conducts an independent tarjîh process grounded in hadith authenticity evaluation and maqâshid al-sharî'ah considerations. This study is the first to specifically document and analyze the position of PERSIS's Dewan Hisbah on this issue, while simultaneously offering an integrative analytical model combining hadith criticism, comparative fiqh, and maqâshid al-sharî'ah.
